03

Improve your next answer

Contracts · Refusal before delivery

Short writing sample

On May 1, Harbor agrees to sell 40 office chairs to Morgan for delivery on June 1. On May 15, Harbor writes: ‘We will not deliver the chairs. We have decided not to honor our agreement.’ Morgan immediately buys replacement chairs at a higher price. On May 20, Harbor offers to perform the original agreement.

Call of the question: Discuss Harbor’s repudiation and whether its later offer to perform is an effective retraction.

Write a short response, then compare it with a fixed example evaluation. This public sample shows a fixed example evaluation; it does not grade your draft.

Identify the issues, state the rules, apply the facts, and reach a conclusion. Your draft stays on this page.
